These Terms of Service ("Terms") govern your use of WorkTop ("Software"), provided by WorkTop by Nystik ("we," "us," or "our"). By installing or using WorkTop, you agree to be bound by these Terms. If you do not agree, do not install or use the Software.

1. Description of Service

WorkTop is a desktop context switcher for Windows that allows you to manage which folder your desktop displays. The Software is available in a free version and a paid Pro version with additional features.

2. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use WorkTop on devices you own or control, for personal or internal business purposes.

Free Version: You may use the free version of WorkTop at no cost, subject to its feature limitations.

Pro Version: Upon purchase of a valid license, you may use the Pro version features on up to the number of devices specified by your license activation limit.

3. License Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Software
  • Reverse engineer, decompile, or disassemble the Software, except where permitted by applicable law
  • Transfer, sublicense, or assign your license to another person
  • Use the Software for any unlawful purpose
  • Circumvent any license enforcement mechanisms
  • Remove or alter any proprietary notices or labels

4. Payment and Refunds

Payment: Pro licenses are sold as one-time purchases through Lemon Squeezy. By completing a purchase, you agree to Lemon Squeezy's terms of service. We do not process payments directly.

License Delivery: Your license key is delivered immediately upon purchase. By completing your purchase, you acknowledge that delivery of digital content begins immediately and that you waive any statutory right of withdrawal that may otherwise apply.

Refunds: If WorkTop Pro does not meet your expectations, you may request a full refund within 14 days of purchase. After 14 days, refunds are available only if the Software does not function as described and we are unable to resolve the issue. To request a refund, contact [email protected] with your order number.

5. Updates

The Software may automatically check for available updates. We may release updates at our discretion but are under no obligation to do so. We do not guarantee that updates will be provided, that future versions will maintain compatibility with your operating system or hardware, or that support will continue indefinitely.

6. Third-Party Services

The Software integrates with third-party services:

  • Lemon Squeezy handles payment processing and license management. Their privacy policy and terms apply to your purchase.

Your use of third-party services is subject to their respective terms and policies.

7. Open Source Components

WorkTop includes third-party open source software. License information and attributions are available in the THIRD_PARTY_LICENSES.txt file included with the Software.

8. Privacy

Your use of WorkTop is governed by our Privacy Policy. By using WorkTop, you acknowledge that you have read and understood our Privacy Policy.

9. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Software will be uninterrupted, error-free, or free from security vulnerabilities, or that defects will be corrected.

10. Limitation of Liability

No Liability for Data Loss

WorkTop manages desktop folder contexts and does not intentionally modify, move, or delete your files. However, you acknowledge that:

  • Software may contain bugs
  • You are solely responsible for maintaining backups of your files
  • We are not liable for any data loss, corruption, or unintended file modifications, whether caused by the Software, user error, or any other reason

Use of this Software is at your own risk. We strongly recommend maintaining regular backups of important files.

General Limitation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Termination

We may terminate or suspend your license immediately if you breach these Terms. Upon termination, you must cease all use of the Software and delete all copies.

You may terminate your license at any time by uninstalling the Software and deleting all copies.

12. Changes to Terms

We may revise these Terms at any time. Changes will be posted at worktop.dev/terms with an updated "Last updated" date. Your continued use of the Software after changes are posted constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Sweden.
